Do You Have to Tell Callers They're Talking to an AI?

Short answer: it depends on where you and your callers are, what kind of call it is, and how the rules change over the next few years. Some laws require you to disclose AI in certain situations, many require you to identify your business at the start of automated calls, and almost everywhere it is risky to let a caller believe they are talking to a person when they are not. The simplest safe practice is to say it in the greeting: "You're speaking with our virtual assistant." You are responsible for the rules that apply to your calls.

This is a high-level overview, not legal advice. Rules vary and change; check with a lawyer where you operate.

Why does disclosure matter even where it isn't required?

Callers usually work it out within a few sentences. If they feel tricked, trust drops for the rest of the call and for your brand. A short, honest line up front costs almost nothing, and callers who would rather talk to a person know to ask for one.

United States

  • Outbound calls fall under the TCPA. In 2024 the FCC ruled that AI-generated voices are "artificial" voices under the Telephone Consumer Protection Act. Calls using an artificial voice must identify the business making the call at the start, on top of the consent rules. See the TCPA and AI calls.
  • Some states go further. A few states have laws about disclosing bots or generative AI to consumers in certain situations, and more bills are introduced each year. Check the states you call into and serve.
  • Misleading consumers is a risk on its own. Federal and state consumer protection law covers deceptive practices, whatever technology is used.

United Kingdom

  • No single rule says "announce the AI" on every call, as far as we are aware at the time of writing.
  • Transparency still applies. UK GDPR requires you to tell people how their personal data is used, and the ICO expects organizations to be open about AI that makes or supports decisions about people.
  • Marketing calls have their own rules. Under PECR, automated marketing calls need specific prior consent; see PECR and TPS.
  • Calling customers in the EU? The EU AI Act includes a duty to tell people when they are interacting with an AI system, unless it is obvious.

United Arab Emirates

  • Telemarketing is regulated. Cabinet Resolution No. 56 of 2024, as summarized by UAE law firms, requires telemarketers to state their identity and the purpose of the call at the start, limits calling hours and sets up a Do Not Call Register. Check the official text before you call.
  • Privacy is taken seriously. The federal data protection law and the free zones' own data protection laws (DIFC, ADGM) expect you to be clear about how you use personal data.

India

  • Telemarketing rules apply to outbound calls, including TRAI's calling-hours and registration requirements.
  • Data protection notice duties under the DPDP Act apply to the personal data you collect on calls.
  • Rules on AI-generated content are developing. Check current guidance before relying on silence. See the India page.

How to word the disclosure

  • Inbound: "Thanks for calling Bayside Plumbing. You're speaking with our virtual assistant. How can I help?"
  • Outbound: "Hi, this is the automated assistant from Bayside Plumbing, calling about your boiler service booking."
  • If asked directly: add an instruction such as "If anyone asks whether you are a real person, say clearly that you are an AI assistant and offer to put them through to the team."

Keep it to one clause. A long legal paragraph at the start of every call makes callers hang up.

Make sure the disclosure is actually heard

Many people say "hello" the moment they pick up, which can cut an agent's opening line short. If the disclosure is in the greeting, set the agent so the greeting always plays to the end.

What ThinnestAI does and doesn't do

  • The agent says the greeting you write, word for word. There is no separate AI-disclosure setting; the disclosure is the line you write.
  • "Let the greeting finish" makes the opening line play to the end even if the caller talks over it; whatever they said is answered next.
  • "Never interrupt the agent" is available for an agent whose replies must be heard in full, such as a required statement.
  • Calling hours are yours to set. Each campaign calls only inside the hours and weekdays you choose, on the called person's clock, so set them inside the rules that apply to you.
  • It does not check consent or national do-not-call registers for you. You keep your own do-not-contact list in the product.

Next step: see how the product works where you are on the US, UK or UAE page.

FAQ

Frequently Asked Questions

Is it illegal to use an AI voice on business calls without saying so?

+
It depends on the place and the kind of call. Some rules require disclosure or identification, and misleading callers is a risk almost everywhere. Saying it in the greeting avoids the question. This is not legal advice.

Does the TCPA require AI disclosure?

+
The FCC treats AI voices as artificial voices under the TCPA, and artificial-voice calls must identify the business at the start, alongside the consent rules. Ask a lawyer how this applies to your calls.

What's a good AI disclosure line for a receptionist?

+
One short clause in the greeting, for example: Thanks for calling Bayside Plumbing, you're speaking with our virtual assistant, how can I help?

Does ThinnestAI announce that it is an AI automatically?

+
No. The agent says the greeting you write, so put the disclosure there, and turn on Let the greeting finish so it is heard in full.

What should the agent say if a caller asks if it's a robot?

+
Tell it in its instructions to answer honestly that it is an AI assistant and to offer a transfer or a callback from a person.
