Welcome to Thinnest.ai ("Thinnest", "we", "our", "us"). These Terms of Service ("Terms") govern your access to and use of our website, dashboard, APIs, software, AI agents, and related services (collectively, the "Services").

By accessing or using the Services, you agree to these Terms and the Privacy Policy below.

2. Eligibility

• You must be at least 18 years old and legally capable of entering into a binding contract under Indian law.
• If you use the Services on behalf of an organization, you confirm that you have authority to bind that organization.

3. Account Registration & Security

• You must provide accurate and complete registration information.
• You are responsible for safeguarding your account credentials.
• You are fully responsible for all activity occurring under your account.

4. Description of Services

Thinnest.ai provides:

• AI-powered chat agents
• AI-powered voice agents (phone calls, WebRTC)
• Conversation analytics, logs, and dashboards
• Usage-based and subscription-based access

AI outputs are generated automatically and may be inaccurate or incomplete.

5. Pricing, Usage & Billing

5.1 Pricing Model

Pricing may include:

• Per-message fees (chat)
• Per-minute fees (voice)
• Platform or agent fees
• Pass-through costs for third-party services (LLM, STT, TTS, telephony)

Pricing details are displayed on the website or dashboard and may change with notice.

5.2 Billing & Payments

• Charges are billed in advance or based on usage.
• Payments are non-refundable, except where required by applicable law.
• Non-payment may result in suspension or termination.

6. Acceptable Use

You agree not to use the Services for:

• Illegal, fraudulent, or deceptive activities
• Spam, scam, or unlawful outbound calling
• Violations of privacy, consent, or telecom laws
• Harassment, abuse, or harmful content

You are solely responsible for compliance with IT Act 2000, TRAI/DoT regulations, consumer protection laws, and other applicable laws.

7. AI & Voice Disclaimer

• AI responses are probabilistic and not guaranteed to be correct.
• Thinnest does not provide legal, medical, or financial advice.
• You must independently verify AI outputs before relying on them.
• Thinnest acts as a technology provider, not a telecom operator.

7A. Data Residency & Compliance

ThinnestAI is hosted on Google Cloud Platform (GCP), region Mumbai (asia-south1).

Data residency depends on your provider selection:

• Indian providers (Sarvam AI, Aero TTS) — all data stays exclusively in India. Zero data leaves the country.
• International providers (OpenAI, Anthropic, Google Gemini) — data may be processed outside India per the provider's policies.

The platform complies with:

• DPDPA 2023 — Digital Personal Data Protection Act
• RBI Data Localization — all payment data stored in India
• TRAI Regulations — telecom compliance for voice operations
• IT Act 2000 — information technology and intermediary compliance

Payment processing is handled by Razorpay (India-based payment gateway). All payment data is stored exclusively in India per RBI mandate.

TRAI compliance tools available on the platform:

• DND/NCPR scrubbing
• IST time-boxing (9 AM – 9 PM)
• AI disclosure toggle
• 140-series telemarketing number support

8. Intellectual Property

• All platform software, UI, branding, and systems are owned by Thinnest or its licensors.
• You retain ownership of your business data and prompts.
• You grant Thinnest a limited license to process data solely to provide the Services.

9. Suspension & Termination

We may suspend or terminate your access if:

• These Terms are violated
• Payments are overdue
• Required by law or regulation

Upon termination, access to Services may cease and data may be deleted after a reasonable period.

10. Limitation of Liability

To the maximum extent permitted by Indian law:

• Thinnest shall not be liable for indirect, incidental, or consequential damages.
• Total liability shall not exceed the fees paid by you in the preceding 3 months.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of India.

Courts located in Bengaluru, India shall have exclusive jurisdiction.
